   FOX affiliates in the Eastern Time Zone were okay since there is no penalty for indecency between 10 p.m. and 6 a.m. As for the rest of the FOX affiliates out there, they have to sweat out any FCC complaints. The maximum fine for a single utterance deemed indecent by the FCC could cost any affiliate receiving a complaint as much as $325,000.

     Not anymore. The 2nd Circuit Court decision coupled with an FCC under Obama that doesn’t go after incidentals means no likely fine.

   The following rules apply to broadcasts in America as regulated by the FCC:

   Obscene broadcasts are prohibited at all times. Obscene material meets all of the following three tests: (a) an average person, applying contemporary community standards, must find that the material, as a whole, appeals to the prurient interest, (b) the material must depict or describe, in a patently offensive way, sexual conduct specifically defined by applicable law, (c) the material, taken as a whole, must lack serious literary, artistic, political, or scientific value. Basically, obscene material is pornographic or similarly suggestive sexual material.

   Indecent Broadcasts Restricted to 10 P.M. – 6 A.M. Indecent is as defined by the Supreme Court in their decision: language or material that, in context, depicts or describes, in terms patently offensive as measured by contemporary community standards for the broadcast medium, sexual or excretory organs or activities.

   It should be noted that some uses of “fu*k” (such as using the word as an action verb meaning sexual intercourse) can be considered obscene, but “shit,” being a excretory activity, cannot. Women’s breasts and all genitalia are considered obscene, so you will never see that on television until “contemporary community standards” get lower.

     The hell are you talking about? Neither breasts nor genitalia are considered obscene. I think you misunderstand the difference between obscenity and indecency.

     You see nude human bodies regularly on PBS broadcasts, for example.

   I think Jimmie should be saying that about Chad’s inability to put together a pit crew that can be something other than a liability. Between the slow stops and stupid mistakes I’m amazed Jimmie has totally lost it. If Chad can’t manage the pit crew they should hire someone who can just do that.

   I don’t blame Chad at all. I don’t like him, but I would have done the same thing. The heck of it is that poor Jr. had to pay a big fine a few years ago for the S-bomb and it doesn’t look like NASCAR will be consistent in this case. That’s OK as long as NASCAR just let’s this stuff be in the future. It makes life interesting!

     Junior was doing an interview live, Fox was ease dropping on a team only channel. Big difference! Also nobody said anything when Junior was leading and once again NASCAR didn’t throw the caution. They want Junior to win at any cost!

       That is one of most ignorant comments I have ever heard, they didnt throw caution cause there was no need to throw a caution. every car kept moving and there was no interference with the race continuing.. so before you jr bashers start running your mouths you should atleast get you facts straight!!!!!!
